CAR ENTRY TERMS & CONDITIONS

DEFINITIONS

“Conditions” means these terms and conditions of entry for the Event.

“Entry Form” means this application form including these Conditions and the Letter of Indemnity which must be completed in order to participate in the Event.

“Event” means the London Concours 2024.

“Letter of Indemnity” means the indemnity letter forming part of the Entry Form to be signed by the Participant and returned to the Organiser.

“Organiser” means Thorough Events Ltd, its officers, employees, suppliers and/or sponsors and/or persons for or to whom the Organiser is answerable.

“Participant” means the owner of the motor vehicle (or its nominee as the case may be) named on the Entry Form; the named co-owner or guest; and any employees the details of whom are entered on the Entry Form (if any).

“Vehicle” means the motor vehicle to be exhibited at or driven in the Event the details of which are set out on the Entry Form.

ENTRY, PARTICIPATION AND CONDITIONS

  1. Entry to the Event as a Participant is by invitation of the Organiser only and the Organiser reserves the right to refuse entry to the Event without reason.
  2. Submission of the Entry Form is confirmation to The Organisers that you have read and fully understood the ‘Terms & Conditions’ as laid out here and the terms of the ‘Indemnity Letter’ as laid out on Pages 9-10 of the Entry Form and you hereby agree to be bound by the terms thereof.
  3. The Vehicle must be legally registered for driving on public roads or on permit (documentary evidence of which must be available for inspection if requested by the Organiser) and be in good running order. (Non-runners and show cars excluded)
  4. The Vehicle may only be driven by the owner(s) or a person nominated by the owner(s) who must be over the age of 21 and hold a current valid full driving licence. A holder of a Learners’ Permit shall not be permitted to drive/ride in the event.
  5. The Vehicle must not be shown or exhibited at any other UK public car shows, events, displays or auctions within 20 days prior to the Event unless the prior written consent of the Organiser has been obtained. The Organiser has the right to refuse the Participant and Vehicle entry to the Event in the event that such prior written consent has not been obtained by the Participant.
  6. The Participant may not substitute the Vehicle for another vehicle without the prior written consent of the Organiser. A request for the Organiser’s consent to substitution of the Vehicle must be made in writing no later than eight weeks before the Event. Consent to substitution is at the sole discretion of the Organiser.

PARTICIPATION AT THE EVENT

  1. The Participant agrees to abide by all applicable rules and regulations of the Organiser and the Honourable Artillery Company that oversee the Event. The Organiser is entitled to impose rules upon the Participant from time to time which will form part of these Conditions.
  2. The Organiser reserves the right at any time to remove the Participant from the Event or to deny participation in the Event if, in the Organiser’s sole opinion, it considers such action necessary for safety reasons or property enjoyment of the Event by other participants in and visitors to the Event.
  3. In consideration for the Organiser granting entry into the Event, the Participant consents to the Vehicle and/or the Participant being photographed, filmed or recorded by other means of storing moving or still picture at the Event and grants to the Organiser all right in perpetuity throughout the world to make the fullest use of the products of such recordings in whole or in part in any media and formats whether now known or hereafter devised. Any film, photograph, or any other recording of moving or still picture and all intellectual property in connection therewith shall remain the property of the Organiser, and where such intellectual property does not automatically vest in the Organiser, these Conditions shall constitute a legally binding assignment thereof. The Participant further consents to the use and reproduction of the Participant’s name, likeness, appearance and photographs, films and recordings by all means and in all media for the purpose of advertising, publicity and otherwise in relation to the exploitation of the Event and/or the promotion of the Event (and future events) provided that such use shall not imply the Participant’s direct endorsement of any official sponsor or supplier of the Event.

LIABILITY AND INSURANCE

  1. The Participant acknowledges that the Organiser does not provide insurance for the Participant and the Participant shall be responsible for obtaining all necessary insurance covers for participation in the Event including without limitation, cancellation, public liability and employee liability insurance against personal injury, death and damage to or loss of property, and fully comprehensive vehicle insurance suitable for participation in an event of this kind. The Participant shall provide with this Entry Form a copy of the Participant’s valid certificate of insurance as evidence of such cover.
  2. Subject to paragraph 12 below, the Organiser shall not be liable to the Participant for any actual or alleged indirect loss or consequential loss howsoever arising suffered by the Participant including but not limited to loss of profits, anticipated profits, savings, loss of business revenue, loss of business, loss of opportunity, loss of goodwill, or any other type of economic loss. The Organiser shall have no responsibility or liability for any loss (or theft) of or damage to the person, property and effects of the Participant or its guests, employees or representatives arising out of the Participant taking part in the Event nor shall the Organiser be liable for any actions of any spectators, visitors or other third parties unless otherwise set out in these Conditions.
  3. Nothing in these Conditions shall exclude or limit the liability of the Organiser for death or personal injury caused by the Organiser’s negligence, fraud or fraudulent misrepresentation or for any matter which it would be illegal for the Organiser to exclude or attempt to exclude liability.
  4. The Participant shall indemnify the Organiser and keep the Organiser fully and effectively indemnified against any and all claims, laws suits and causes of actions including without limitation for loss of or damage to any property or injury to or death of any person arising from breach by the Participant of these Conditions and/or by any act or omission of the Participant, its employees, agents, sub-contractors or invitees.
  5. Owners are responsible for all risk to themselves and their vehicles. The organiser will not be held responsible for care, custody or control.

CHANGES AND CANCELLATION

  1. The Organiser reserves the right to cancel or change the venue and/or date of the Event at any time and for any reason (including, without limitation if a Force Majeure Event which may prevent the Organiser from fulfilling its obligations under these Conditions). “Force Majeure Event” shall mean and include fire, flood, natural disaster, casualty, lockout, strike, labour disputes, industrial action of any kind, unavoidable accident, breakdown of equipment, national calamity or riot, Act of God, any cause or event arising out of or attributable to war, or any other cause of event (whether of a similar or dissimilar nature) outside the control of the Organiser and, to the fullest extent permitted by law, the Organiser shall not be liable to the Participant for any loss, delay, damage or other liability incurred resulting from or arising in connection with the cancellation or the changing of the date or venue of the Event.
  2. The Organiser’s decision is final in any dispute or discussion and any and all trophy and award decisions will be final and no discussion or correspondence shall be entered into with the Participant.
  3. The Organiser reserves the right, at any time, to make any changes to the Conditions or impose any additional regulations which, in its sole discretion, it deems necessary or in the best interests of the Event.
  4. To cancel your entry to the Event you must notify the Organiser in writing at least 30 days prior to the Event. These Conditions and your participation in the Event are governed by English law and you submit to the exclusive jurisdiction of the English courts.
